These General Terms and Conditions apply to all of online purchases made by customers (businesses or consumers) from our online shop (“e-shop“) and supplied by Muziker,a.s. (“Muziker”). A consumer is any person, who concludes a legal transaction for purposes that can be primarily attributed neither to a trade nor a profession. A business is natural or legal person or a partnership with legal capacity which, in concluding a legal transaction, is acting in the exercise of its trade or profession.
When purchasing a product, a Contract is being made between the customer and Muziker. For enquiries, claims or objections contact our customer service.

Offer and Ordering
The product catalog in the Online Shop does not constitute a legally binding offer.
It is only a non-binding online catalogue of the range of products available.
Muziker does not warrant the accuracy or completeness of the information provided on the website.
By clicking “Buy“, the customer makes a legally binding commitment to purchase the goods in the shopping basket.
An order confirmation will be sent immediately after the order has been submitted.
Muziker will indicate its Acceptance of an order by acknowledging the order via e-mail.
Right of Cancellation
If the customer is a consumer, he/she has the right to withdraw from this Contract without giving any reason within 30 days.
You have the right to withdraw from this Contract without giving any reason within 30 days from the day on which the customer or a third party appointed by the customer (other than the carrier) receives the final goods purchased.
The right to withdraw from this Contract made online has only the consumer who had ordered the goods solely for private use. The right of withdrawal does apply to legal persons / businesses, but this option is considered individually.
In order to exercise the statutory right of withdrawal, the customer must notify Muziker of his/her decision to withdraw from this Contract in a clear declaration (e.g. by sending a letter by mail or an e-mail) to the following address:

The customer may use the Withdrawal Form Template attached for this purpose to the order confirmation e-mail, although, this is not obligatory.
Please, print the Form and attach it to the returned goods.
Consequences of withdrawal
If the customer withdraws from this Contract, we (Muziker) must reimburse any payments we have received from the customer, including the cost of delivery (excluding any additional costs incurred when the customer has selected a different type of delivery to the cheapest standard delivery option offered by us) without delay, and no later than 14 days after the day on which we receive the notice of the customer’s withdrawal from this Contract. We may withhold the reimbursement until we have received the returned goods or until the customer has provided proof that he/she has returned the goods, whichever is earlier.
Unless otherwise agreed, we will use the same payment method the customer used for the original transaction in order to provide the reimbursement. Under no circumstances will Muziker charge the customer a fee for this refund.
We will schedule a pick up through a courier company and cover the costs. If you decide to return the goods by other method, you will bear the whole cost of returning the goods to us (including packaging). In that case, please send the goods including the withdrawal form to the following address:

The statutory right of withdrawal shall not apply in the following cases:
- purchased goods which are not prefabricated and have been manufactured on the basis of a personal choice or according to customer specifications, or any goods which have been tailored to the customer’s personal requirements.
- purchases of sealed goods which are not suitable to be returned for hygiene and health protection related reasons(e.g. In-Ear headphones, mouthpieces for wind and brass instruments, harmonicas), if their seal has been removed after delivery.
- delivery of audio or video recordings or computer software in a sealed packaging if the seal has been removed after delivery.
The customer is responsible for keeping the goods safe from soiling or damages. Wherever possible, please, return the goods in the original packaging together with all the product accessories and components. The customer may use a protective transport packaging.
In case of consumable goods (for example strings, electron tubes, cleaning products, sticks, drum skin etc.) it is only possible to withdraw from contract if the buyer returns the goods packed in original undamaged packaging, unused, without any damage, wear and staining to the product.
If the original packaging is no longer available, please, ensure the goods are packaged in a way that will provide sufficient protection from being damaged during transport. Failing to do so will incur damage compensation charges for the customer. These provisions do not affect your statutory right of withdrawal from this Contract.
Pricing and Delivery charges
All prices for products quoted on our website are inclusive of legally applicable VAT.
If the total value of order is 49 EUR, or less, within Slovakia,
the customer will have to pay a delivery fee of 3,50 EUR per domestic order.
For orders in excess of 49 EUR, we will post goods free of shipping costs.
The exact delivery charge can be found on our website specifically for each product,
in the shopping basket, and on the order form.
Delivery PolicyProducts will be delivered by courier services.
The orders are delivered to the address provided during the ordering process.
After the goods have been dispatched, we will send you an e-mail with a link
which you can use to check the current status and progress of your delivery.
Unless the information on the product page states otherwise, all goods (except from the good from our display or B-stock) are ready to be dispatched immediately and delivered within
1 working day.
If the expected delivery is different, this information will be stated on the product page.

DHL (standard parcels)
DHL Saturday delivery
Purchase anything is in stock at e-shop on Friday until 16:00 CET. (no later)
As shipping method choose a courier "DHL Saturday Delivery".
As payment method select Cash On Delivery or some of the quick online payment options. (PayPal, Viamo, Credit Card, etc.)
Saturday delivery is subject to some logistic limitations, that we must respect.
Only "In Stock" packages, only weigh less than 50 kg, only packages with max edge 120 cm,
only pre-paid, or COD Shipments can be sent and delivered in this way.
GEIS (oversized parcels)
Orders can be paid for using the following methods.
All prices displayed include VAT and currency is EURO.
Cash on delivery
You can pay for goods in cash upon their delivery directly to the courier.
You can make a fast online bank transfer through payment gateway TrustPay. This way your payment reaches our account immediately. TrustPay is an advanced online banking method which guarantees the highest degree of security and it is authorized and regulated by the National Bank of Slovakia.
PayPal is the most commonly used payment system in the world. If you have a PayPal account you know it is a fast, easy and secure way to pay.
Online card payment
After submitting your order you will be redirected to a secure payment gateway where you can pay using the following cards: VISA, MasterCard, Maestro or Dines Club International.
Just enter the required card details and submit the payment. The bank will immediately inform us when the transaction is complete and we can therefore dispatch the order without delay.
Viamo - online Gateway
If you have a VIAMO app installed on your device, use the "Pay via VIAMO" button, vhen finished your order. Viamo is an advanced online banking method which guarantees the highest security level.
After submitting your order, the system will automatically provide you with all the payment details. You will also receive an e-mail with a Proforma Invoice. You can transfer the payment by logging into your online banking. The goods will be shipped upon your payment reaching our account.
Payment upon collection from a pick-up point
If you have selected “Collection“ in your order, you can pay for the goods immediately after completing your order or when collecting the goods in cash or by card.
Repayments to Quatro Finance
If you have a regular income, you can purchase goods by taking out a loan from Quatro Finance. In your basket, simply select “Repayments“ option as a payment method and choose a finance company. After completing your order click on “Apply for a loan“ and you will be redirected to the Quatro webpage where you can fill out the form and submit your loan request. Once the loan has been approved, Quatro will send the contract to your e-mail address. It is necessary to print and sign the Contract and send it back to Quatro by post immediately. Allow 1-2 business days for the contract to reach Quatro. Upon receiving the signed Contract Quatro will instruct us to release the goods and we will subsequently dispatch the order to your address.
Repayments to Home Credit Finance
If you have a regular income, you can purchase goods by taking out a loan from Home Credit Finance. In your basket, simply select “Repayments“ option as a payment method and choose a finance company. After completing your order click on “Apply for a loan“ and you will be redirected to the Home Credit webpage where you can fill out the form and submit your loan request. Once the loan has been approved, Home Credit will send the contract to your e-mail address. It is necessary to print and sign the Contract and send it back to Home Credit by post immediately. Allow 1-2 business days for the contract to reach Home Credit. Upon receiving the signed Contract Home Credit will instruct us to release the goods and we will subsequently dispatch the order to your address.

Retention of Title
The goods shall remain the property of Muziker until all of the outstanding claims against the customer have been paid in full.
Transport Damage during Shipment
If you (consumer) notice that the product you have received is damaged and this damage is not immediately obvious upon inspection, please, contact our Customer service center within 2 business days:
If there is another piece in stock and available to be dispatched
immediately, we will ensure an exchange and transport without delay.
You will hand over the defective product to the courier and, as soon as it arrives to us, a new piece will be sent to you.
Warranty and Compensation
Muziker provides a
warranty on new musical instruments and sound equipment. The warranty period on new musical instrument accessories and other products will be
in accordance with the legal regulations. In the case of certain consumables (e.g. plectrums, drum heads and sticks, strings and tubes etc.), whose expected lifespan is
only manufacturing and material defects are being considered during the warranty period as a valid reason for a refund or an exchange.
Extended warranty period
During the extended warranty period (beyond the statutory 24 months) Muziker’s authorized service center reserves the right to modify certain aspects of the warranty. For example, the 30-day free product repair period changes to ‘indefinite’ (the free repair period is subject to individual agreements between the service center and the customer, taking into account the time needed to ensure a genuine spare part needed for the repair).
Despite this adjustment, Muziker service center is committed to carry out the repair without undue delay.
You can file a claim for damages caused by prolonged claim process only in a case where it can be proven that the delay was caused deliberately, or due to gross negligence on the part of the service center.
If a product exchange takes place during the 12-month warranty extension (following the 24-month statutory warranty period), the customer is not automatically entitled to another 36-month warranty. The original product’s warranty period transfers to the new product.
Cymbals fall into a special category of products due to the nature of material and the method of use that are subject to a natural wear and tear. Therefore, there is only a 24-month warranty on these products. When processing a claim, Muziker service center will carry out an expert assessment of the product taking into consideration the signs of wear and tear from normal use, as well as exclusion of liability for defects due to mechanical damage caused by a blow with intensity exceeding the level of mechanical resistance of the material.
Each product purchased online comes with an electronic invoice (sales receipt when buying in a store) which also serves as a warranty card. The warranty period begins on the date of receipt of the goods and is extended by the period during which the product was undergoing a warranty repair.
Termination of the guarantee
- mechanical damage of goods caused by negligent or improper treatment of the goods by the buyer
- improper installation, handling or malpractice by the buyer
- using the goods in inadequate conditions by the buyer
Defects or any other damage caused by improper handling, unprofessional installation, the use of unsuitable accessories or changes made to the original parts by the customer or a third party are not covered by the warranty.
The warranty does not cover any mechanical damage due to using the goods in inadequate/unsuitable conditions (dusty, humid, chemically aggressive, strong magnetic fields, etc.) or if the goods have been interfered with by the buyer or a third party not commissioned by an authorized person (by Muziker).
This warranty does not cover the damages or defects caused by natural disasters and improper voltage supply. Signs of wear and tear from normal use are also excluded from the warranty.
The seller also offers conclusion of purchase contract for b-stock goods. B-stock goods stand for goods that have been previously opened, have damaged packaging, have been used and returned or damaged goods.
B-stock goods are not eligible for a replacement with a new piece after withdrawal from the contract or when claiming using a warranty.
Warranty claims for b-stock goods fall accordingly under the warranty rules, unless stated otherwise in this section.
It is not possible to file for a warranty claim for a "defect" or other reason, for which the goods were sold for a discounted price.
The advertising of products on our website constitutes an “invitation to
treat”; and your order for products constitutes a contractual offer. No
contract will come into force between the customer and us unless and
until we accept the order in accordance with the procedure detailed
below. In order to enter into a contract to purchase products from us,
the customer will need to follow the steps as described below in detail:
Any product the customer wishes to purchase must be placed into the shopping basket by clicking on “Add to basket“; the content of the shopping basket can be reviewed anytime by clicking on “Shopping basket“. Added products can be removed from the shopping basket using the “Delete“ button.
When ready to purchase the chosen products in the shopping basket, click “Continue“
The customer will be asked to provide their Muziker account details (new customers will have to open an account with us before proceeding); mandatory fields are marked with „*“
The customer is then asked to choose the payment method and details (all the customer data is processed using encryption)
To check the order and all the information before completing the order, click “Final Review“
To finalize the purchase and submit the order, click “Buy“
Ordering process can be cancelled anytime by closing the browser window.
These General Terms and Conditions of Use can be viewed on our website anytime.
They will also be sent as an attachment to the e-mail with the Order confirmation.
